General Terms and Conditions

1. Scope

These General Terms and Conditions (GTC) apply to all orders and business relationships between BEAUTYSTORE and its customers via the online shop www.beautystore.ch. The offer is intended exclusively for customers residing in Switzerland or the Principality of Liechtenstein.

A customer is any natural or legal person entering into a business relationship with BEAUTYSTORE GmbH.

By placing an order, the customer agrees to these GTC. We reserve the right to amend these GTC at any time if changing legal, technical or operational circumstances require such amendment and if the amendment is reasonable taking into account the interests of our customers. The version published at the time of the order shall apply.

2. Provider and technical platform

The contractual partner for all orders is exclusively:

The online shop is technically operated via the Shopify Inc. platform. Shopify provides the technical infrastructure (shop system, checkout, hosting), but is not a contracting party to the purchase agreements concluded via this shop. All purchase agreements are concluded exclusively between the customer and BEAUTYSTORE GmbH.

3. Offer and product presentation

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order. Product images, descriptions and other details are provided for information purposes only. Minor deviations are possible, for example colour deviations depending on screen display.

BEAUTYSTORE GmbH is entitled to adjust the product range at any time or remove products from the offer without prior notice. All information regarding availability and delivery times is without guarantee and may change at any time.

4. Prices

All prices are stated in Swiss francs (CHF) and include statutory value added tax unless otherwise indicated. Any shipping costs are shown separately during the ordering process and must be paid by the customer. Price changes and errors are reserved.

5. Conclusion of contract

By clicking the button “Submit order”, the customer makes a binding offer to conclude a purchase contract. After receipt of the order, an automatic order confirmation is sent by email. This confirmation does not yet constitute acceptance of the contract. The contract is only concluded once BEAUTYSTORE GmbH expressly confirms the order or dispatches the goods.

If an order cannot be fulfilled, or can only be partially fulfilled, the customer will be informed. Payments already made will in this case be refunded in full. In the event of contract cancellation, BEAUTYSTORE is under no obligation to provide a replacement delivery or compensation for damages.

6. Payment methods and retention of title

The payment methods activated at checkout are available, in particular credit card (Mastercard & VISA), TWINT, Apple Pay, Google Pay, PayPal and, where offered, Klarna payment methods (invoice purchase, pay later, instalments). BEAUTYSTORE GmbH reserves the right to exclude certain payment methods in individual cases or make them subject to additional conditions, for example risk assessment or order value. No cash discount is granted.

Orders over CHF 1,000.00 are processed exclusively using TWINT, PayPal or credit card.

The delivered products remain the property of BEAUTYSTORE GmbH until full payment has been made.

Klarna (invoice purchase / pay later / instalments)

If available at checkout, payments can be processed via Klarna. If a Klarna payment method is selected, payment processing takes place directly through Klarna; depending on the payment method, additional checks may be required, for example identity or credit checks. The Klarna terms and conditions, which are displayed and linked during checkout, also apply to the use of Klarna.

7. Delivery

Delivery is generally made within 1 to 5 business days from receipt of the order or after payment approval. Depending on the product, shipping is carried out by Swiss Post or PLANZER to the delivery address provided by the customer. Invoices are sent by email or by post.

Upon handover of the goods to the transport company, benefit and risk pass to the customer to the extent permitted by law.

If delivery is not possible or acceptance is refused, BEAUTYSTORE GmbH may withdraw from the contract after written notice by email and after granting a reasonable period, and may charge the expenses incurred.

8. Inspection obligation and notice of defects

The customer is obliged to inspect the goods immediately upon receipt and to report obvious defects, including transport damage, without delay in writing by email. If no notice is given, the goods are deemed approved. Failure to give notice has no consequences for statutory warranty claims.

9. Voluntary return policy (14 days)

BEAUTYSTORE GmbH grants a voluntary return period of 14 days from receipt of the goods. The goods must be returned to us within this period; timely dispatch is sufficient to meet the deadline.

Requirements:

Goods complete, in original packaging, unopened, unused and undamaged
Not specially manufactured according to customer specifications or tailored to personal needs

Excluded from the return policy are:

Gift vouchers, provided they have already been stored in the user account
Custom-made products
Items that cannot be returned for hygiene or health protection reasons if their seal has been removed after delivery

The return is made at the customer’s cost and risk. The goods must be returned together with the delivery note and the reason for return to:

In the event of improper handling or loss in value, BEAUTYSTORE GmbH reserves the right to demand appropriate compensation and deduct the reduction in value from the purchase price already paid or invoice it to the customer.

10. Warranty

The statutory warranty provisions of Swiss law apply. In the event of justified defects, BEAUTYSTORE GmbH shall decide at its own discretion whether to provide a replacement delivery or refund the purchase price. Further claims are excluded to the extent permitted by law.

If an item is no longer available, we will inform the customer of the unavailability and refund any payments received in full.

11. Liability

BEAUTYSTORE GmbH is liable only for damages resulting from intentional or grossly negligent breach of duty. Liability for indirect damages, consequential damages, lost profit or pure financial losses is excluded to the extent permitted by law. Mandatory statutory liability provisions remain reserved.

Our website may contain links to external third-party websites. We have no influence over their content and assume no liability for them. The respective provider or operator is always responsible for the content of linked pages.

12. Intellectual property

All content on this website, including texts, images, logos and designs, is protected by copyright. Any reproduction, editing or use requires the prior written consent of BEAUTYSTORE GmbH. In the case of third-party contributions or images, the source information is provided.

13. Data protection

Personal data is processed in accordance with the Privacy Policy of BEAUTYSTORE GmbH, which can be viewed on the website. Technical processing in the shop and checkout is carried out via Shopify. When using external payment methods, for example Klarna, the data required for payment processing is transmitted to the respective payment service provider.

14. Severability clause

Should any provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.

15. Applicable law and place of jurisdiction

Swiss substantive law shall apply exclusively, excluding conflict-of-law rules. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. The place of jurisdiction is Wolfhausen ZH, unless mandatory statutory places of jurisdiction take precedence.
