1. Scope

These General Terms and Conditions (GTC) apply to all orders and business relationships between BEAUTYSTORE and its customers via the online shop www.beautystore.ch. The offer is exclusively aimed at customers with a domicile in Switzerland or the Principality of Liechtenstein.

A customer is defined as any natural or legal person who enters into business relations with BEAUTYSTORE GmbH.

By placing an order, the customer agrees to these GTC. We reserve the right to adapt these GTC at any time if changed legal, technical or operational conditions require it and the adaptation is reasonable taking into account the interests of our customers. The version published at the time of the order shall apply.

2. Provider and Technical Platform

The contractual partner for all orders is exclusively:

The online shop is technically operated via the Shopify Inc. platform. Shopify provides the technical infrastructure (shop system, checkout, hosting), but is not a contracting party to the purchase agreements concluded via this shop. All purchase agreements are concluded exclusively between the customer and BEAUTYSTORE GmbH.

3. Offer and Product Presentation

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding invitation to order. Product images, descriptions, and other information serve for informational purposes. Minor deviations (e.g., color variations depending on screen display) are possible.

BEAUTYSTORE GmbH is entitled to adjust the assortment at any time or remove products from the offer without prior notice. All information regarding availability and delivery times is without guarantee and may change at any time.

4. Prices

All prices are in Swiss Francs (CHF) and, unless otherwise stated, include statutory VAT. Any shipping costs will be shown separately in the ordering process and must be paid by the customer. Price changes and errors are reserved.

5. Conclusion of Contract

By clicking the "Submit Order" button, the customer makes a binding offer to conclude a purchase agreement. After receipt of the order, an automatic order confirmation will be sent by email. This confirmation does not yet constitute acceptance of the contract. The contract is only concluded when BEAUTYSTORE GmbH explicitly confirms the order or dispatches the goods.

If an order cannot be carried out, or only partially, the customer will be informed. Any payments already made will be fully refunded in this case. BEAUTYSTORE is not obliged to provide replacement delivery or compensation in the event of contract termination.

6. Payment Methods and Retention of Title

The activated payment methods are available in the checkout, in particular credit card (Mastercard & VISA), TWINT, Apple Pay, Google Pay, PayPal, and – if offered – Klarna payment methods (purchase on account, pay later, installment payment). BEAUTYSTORE GmbH reserves the right to exclude certain payment methods in individual cases or to make them dependent on additional conditions (e.g., risk assessment, order value). A cash discount is not possible.

Orders over CHF 1,000.00 will only be processed with TWINT, PayPal or credit card payment methods.

The delivered products remain the property of BEAUTYSTORE GmbH until full payment.

Klarna (Purchase on account / Pay later / Installment payment)

If available in the checkout, payments can be processed via Klarna. When selecting a Klarna payment method, payment processing takes place directly via Klarna; depending on the payment method, additional checks (e.g., identity or creditworthiness check) may be required. The Klarna GTC also apply to the use of Klarna, which are displayed and linked in the checkout.

7. Delivery

Delivery usually takes place within 1 to 5 working days from receipt of order or after payment clearance. Depending on the product, shipping is carried out by Swiss Post or PLANZER to the delivery address specified by the customer. Invoicing is done by email or by post.

With the handover of the goods to the transport company, the benefits and risks pass to the customer, as far as legally permissible.

If delivery is not possible or acceptance is refused, BEAUTYSTORE GmbH may withdraw from the contract after written notification by email and after setting a reasonable deadline, and charge for the expenses incurred.

8. Obligation to Inspect and Notification of Defects

The customer is obliged to inspect the goods immediately upon receipt and to report any recognizable defects, including transport damage, immediately in writing by email. If no report is made, the goods are deemed to be approved. Failure to complain has no consequences for statutory warranty claims.

9. Voluntary Right of Return (14 Days)

BEAUTYSTORE GmbH grants a voluntary right of return of 14 days from receipt of the goods. The goods must be returned to us within this period; timely dispatch is sufficient to meet the deadline.

Prerequisites:

• Goods complete, in original packaging, unopened, unused and undamaged
• Not specially manufactured according to customer specifications or tailored to personal needs

Excluded from the right of return are:

• Gift vouchers, if they are already stored in the user account
• Custom-made products
• Items that cannot be returned for hygienic or health protection reasons, provided their seal has been removed after delivery

The return is at the expense and risk of the customer. The goods must be returned together with the delivery note and the reason for return to:

In case of improper handling or loss of value, BEAUTYSTORE GmbH reserves the right to demand reasonable compensation and to deduct the depreciation from the already paid purchase price or to charge it to the customer.

10. Warranty

The statutory warranty provisions of Swiss law apply. In the event of justified defects, BEAUTYSTORE GmbH will decide, at its sole discretion, whether to provide a replacement delivery or refund the purchase price. Further claims are excluded, as far as legally permissible.

Should an item no longer be available, we will inform the customer of the unavailability and fully refund any payments received.

11. Liability

BEAUTYSTORE GmbH is only liable for damages resulting from intentional or grossly negligent breach of duty. Liability for indirect damages, consequential damages, lost profits or pure financial losses is excluded, as far as legally permissible. Mandatory statutory liability provisions remain reserved.

Our website may contain links to external third-party websites. We have no influence on their content and assume no guarantee for them. The respective provider or operator of the linked pages is always responsible for their content.

12. Intellectual Property

All content on this website – including texts, images, logos and designs – is protected by copyright. Any reproduction, processing or use requires the prior written consent of BEAUTYSTORE GmbH. For contributions or images from third parties, the source information will be provided.

13. Data Protection

The processing of personal data is carried out in accordance with the BEAUTYSTORE GmbH privacy policy, which can be viewed on the website. Technical processing in the shop and checkout is carried out via Shopify. When using external payment methods (e.g., Klarna), data necessary for payment processing is transmitted to the respective payment service provider.

14. Severability Clause

Should a provision of these GTC be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be deemed replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.

15. Applicable Law and Jurisdiction

Substantive Swiss law applies exclusively, excluding conflict of law rules. The UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. The place of jurisdiction is Wolfhausen ZH, unless mandatory statutory places of jurisdiction take precedence.
